MOTION FOR WAIVER OF SERVICE

This Motion is in support of Uber's Federal Racketeering lawsuit they recently filed against Downtown LA Law in Los Angeles: https://ecf.cacd.uscourts.gov/doc1/031145433338

Appellant would like to bring the following racketeering allegations to This Court's attention while he was one of their clients. Appellant was in a car wreck that was 100% the other person's fault in Los Angeles on April 11, 2019 while working for and on a Postmates food delivery. He used Appellee's search engine to find Downtown LA Law on Vermont Avenue in East Hollywood for legal representation after his car wreck that left him with a broken vertabre in his neck from the seatbelt. Downtown LA Law employee Christina Cervantes promised Appellant $300,00.00 - $400,000.00 in 6 months if he went ahead with 2 surgeries, which he reluctantly did under Dr. Fuller in the 8900 Block of Wilshire Blvd., in Beverly Hills. A recent U.S. Court of Appeals for the 2nd Circuit ruling clearly states employers are responsible for their employees' actions (see: Law.com). Still no money unless if Appellant undergoes MORE UNNECESSARY SURGERY. Right off the bat, the imaging places Downtown LA Law sent Appellant to (Western Imaging & Shin Imaging) ALL COMMITTED MEDICAL FRAUD AGAINST plaintiff claiming there is no metallic object embedded in his chest with their CAT (computer axial tomography) scans, as Appellant pointed out to The U. S. District Court for the Central District of California, Western Division in case 2:23-cv-00189-MWF-JC. Here is the proof they committed medical fraud against plaintiff: www.robkettenburg.com/CAT1.jpg and www.robkettenburg.com/CAT2.jpg - All you have to do is wave ANY working (airport wand) metal detector in front of Appellant's chest while he's not wearing a shirt for proof. The CAT scans of Appellant's chest from the imaging centers that Downtown LA Law sent Appellant to make no mention of a metallic chip embedded in his chest. Again, all you have to do is wave an airport wand style metal detector in front of Appellant's chest to set it off, with his shirt on or off. Speaking of losing one's shirt, Downtown LA Law SAT on Appellant's money and refused to pay him his promised residual check after we settled out of Court for $90,000.00 in October of 2021 while Downtwon LA Law was fully aware Appellant was homeless and living on the streets of Los Angeles for 6 weeks with nothing but the clothes on his back and a backpack. Appellant's mother, father, brother and his 6 best Army buddies were all murdered, plus his step mother, step father, step sister, ex-wife and all of his grandparents (real and step) are ALL dead. Appellant has no living relatives. After 6 weeks of walking the streets of Los Angeles homeless waiting for a residual check that never came, Appellant accidentally fell down and broke a bone in his foot + sprained his ankle in the same foot. This led him to the VA hospital in Santa Monica/Westwood where they gave him crutches after an X-ray and told Appellant to stay off of his feet for 3 days. They then asked Appellant about his housing situation and he told them the truth: he was homeless. They then directed Appellant over to a VA case manager who specializes in getting housing for homeless veterans and they called and paid for an Uber to take me to the VA homeless shelter at 6814 South Avalon in Los Angeles, which is where Appellant stayed for 4 months after which he was told by management that he graduated and could spend the last 2 months of his free stay at The Russ Hotel on Skid Row (room 259). Appellant wants to THANK the VA case workers for helping him out as 6 months with no bills allowed him to save up the rent money to move into the apartment that he's in right now and has been since August 31, 2022. While Appellant was in the homeless shelter, he crossed paths with a veteran by the name of 'Emir' who was struck by a woman that was driving too fast while he was walking across an intersection in Los Angeles. She was fully insured and Appellant brought Emir over to Downtown LA Law for legal representation as he cleary needed help, being in a wheelchair. Appellant also gave Downtown LA Law FREE advertising on his home page, sending them MORE clients and business in the hopes of getting his case settled ASAP. But it was NOT to be as Appellant refused more UNNECESSARY surgeries and shortly after he moved into his current dwelling he received a bill in the mail from Downtown LA Law for over $7,000.00! Appeallant wishes to throw his weight behind Uber's allegations of racketeering, generating false medical records and unnecessary surgeries for money levied against Downtown LA Law.
