MOTION FOR WAIVER OF SERVICE

Last night while Appellant was delivering pizzas for Dominos (502) 425-5170, another attempt on his life was made. As Appellant returned to his store after making a delivery last night, his co-worker "Daniel Bratcher," who drives a green Chevy Malibu, was right behind him and his unknown buddy in a pickup truck was following Daniel. They both parked next to eachother in the middle of the parking lot, which is very unusual as delivery drivers always park right next to the store (there were plenty of spaces available, but they chose not to park next to me(?)). Daniel walks back into the store with his two deliveries (pizzas) sets them down next to the door and takes off, without the deliveries. Appellant's co-worker Francisco (Frank) Irizarry, who drives a white Kia Sorrento SUV with license plate 747EEG, made especially sure that I was to take these deliveries. Other co-workers have informed me that Frank frequently bad-mouths me behind my back when I'm not present, so I usually ignore him. I wave to him when I see him out on deliveries and he never waves back. For a delivery driver as experienced as Dan, I found the odds that he would leave his delivery (in two large Dominos Pizza hot bags) in the store and then take off without it highly unlikely. I've also noticed that whenever the Manager Calvin McPherson isin't present, as was the case last night, an attempt on my life is usually made, and last night was no exception. There were two deliveries, one a long distance jaunt to Bay Arbor Drive and the other was to Springbourne Way/Springmere Circle. I took the long distance delivery first without problem. After I delivered the second pizza to the second location, I turned right onto Springhurst Boulevard, which is a four-lane divided highway and into the right lane, on my way back to the store. There were people sitting outside in chairs right next to the second delivery area: it was night-time and about 50 degrees. As I turned right and made my way back, another car came into my section of the divided highway and drove right at me (they were driving on the wrong side of the highway). Fortunately, I was in the right lane and they were in the left lane. It's interesting to note that had I made that delivery first, I would have had to get into the left lane to turn left on Westport Road and make the long distance delivery out to Bay Arbor for the second delivery and I would probably be dead right now, or at the very least very seriously injured, as not only was there another car going down the wrong side of the highway, it was traveling at warp speed - full throttle. When I returned to the store, I could here the thoughts in Dan's head loud and clear: "It didn't work." Frank disappeared. Therefore, Appellant formally charges the unknown driver of said unknown vehicle, along with his two co-workers Daniel (Dan) Bratcher and Francisco (Frank) Irizarry with Title 18 of the US Code, Sections 241, 242, 373, 1113, and 1117.
